(Dikemas kini) PUTRAJAYA: Buat kali kedua dalam tempoh lima bulan, lebih 58,000 pengundi Parlimen Permatang Pauh akan kembali ke pusat pengundian untuk memilih wakil rakyat mereka yang baru - pada 26 Ogos ini.

Penamaan calon bagi pilihan raya kecil itu, yang pertama selepas pilihan raya umum ke-12, ditetapkan pada 16 Ogos dengan tempoh untuk berkempen selama 10 hari.

Pagi ini, Suruhanjaya Pilihan Raya (SPR) menetapkan hari penamaan calon dan pengundian pilihan raya kecil itu selepas ia dikosongkan oleh penyandangnya Datuk Seri Dr. Wan Azizah Wan Ismail pada Khamis lalu.

Dr. Wan Azizah, Presiden PKR memberi laluan kepada suaminya, Datuk Seri Anwar Ibrahim bertanding di kawasan itu.

Dalam pilihan raya umum 8 Mac lepas, Dr. Wan Azizah memperoleh 30,338 undi bagi menewaskan Datuk Pirdaus Ismail dari Barisan Nasional dengan majoriti 13,388.

Kerusi itu juga pernah diwakili oleh Anwar semasa beliau masih dalam Umno.

Setiausaha SPR, Datuk Kamaruzaman Mohd. Noor ketika dihubungi mStar Online memberitahu, tempoh berkempen 10 hari adalah mencukupi bagi pilihan raya kecil.

Kata beliau, SPR mempertimbangkan kemungkinan untuk mengadakan pilihan raya kecil secepat mungkin.

"Undang-undang memperuntukkan minimum tujuh hari. Jumlah hari pada kali ini adalah lebih berbanding tempoh kempen pilihan raya umum 2004," kata beliau.

Pada pilihan raya umum ke-12 8 Mac lalu, SPR memperuntukkan tempoh berkempen 13 hari.

Ketika ditanya mengapa pilih Selasa sebagai hari untuk membuang undi, beliau memberitahu, dengan mengambil kira jumlah hari untuk berkempen selama 10 hari, hari ke-11 iaitu hari pengundian jatuh pada hari Selasa.

Seramai 58,459 pemilih layak yang terdiri daripada 57,969 pemilih biasa dan 490 pengundi pos layak mengambil bahagian dalam pilihan raya kecil kali ini.

Dalam kenyataan yang dikeluarkan selepas mesyuaratnya yang bermula 10 pagi, Pengerusi SPR, Tan Sri Abdul Rashid Abdul Rahman berkata, writ pilihan raya akan dikeluarkan esok manakala notis pilihan raya pula hari keesokan.

"SPR memberi nasihat kepada semua pihak terutamanya parti-parti politik, calon-calon dan petugas-petugas parti dan individu lain yang terlibat perlu sentiasa mematuhi undang-undang pilihan raya serta tatasusila berkempen yang ditetapkan agar dapat menjaga ketenteraman dan keselamatan awam," katanya.

Daftar Pemilih Induk 2007 yang diwartakan pada 5 Februari 2008 dan Daftar Pemilih Tambahan Suku Tahun Pertama tahun 2008 yang diwartakan 19 Jun lalu dan dikemas kini sehingga 31 Julai lalu akan digunakan dalam pilihan raya kecil Permatang Pauh.

Tambah beliau, buat masa ini terdapat beberapa kes petisyen pilihan raya bagi pilihan raya umum 2008 yang masih berada di peringkat perbicaraan.

"Oleh itu calon-calon diingatkan supaya tidak menyentuh isu-isu yang melibatkan kes-kes petisyen dalam kempen-kempen mereka," katanya.

SPR telah melantik untuk pilihan raya itu, Pegawai Daerah Seberang Perai Tengah Roslan Yahaya sebagai Pegawai Pengurus dan tiga penolong Pegawai Pengurus iaitu Setiausaha Majlis Perbandaran Seberang Perai Zainol Abidin Md Noh, Ketua Penolong Pegawai Daerah (Pengurusan) Seberang Perai Tengah Kamarul Haizal Koderat, dan Penolong Pegawai Daerah (Tanah) Seberang Perai Tengah Azizal Ahmad.

'Saya akan hadir di mahkamah hadapi tuduhan liwat, esok' - Anwar

(Dikemas kini) PETALING JAYA: Bekas Timbalan Perdana Menteri, Datuk Seri Anwar Ibrahim berkata, beliau akan hadir di Mahkamah Majistret Kuala Lumpur pagi esok untuk menghadapi tuduhan meliwat.

"Esok saya akan menghadapi pertuduhan fitnah yang saya tidak lakukan, tuduhan yang digunakan untuk aibkan sama seperti pada tahun 98 dan 99," kata beliau pada sidang akhbar kira-kira pukul 3.15 petang ini di Ibu Pejabat Parti Keadilan Rakyat (PKR) di sini.

Beliau akan diwakili pasukan sembilan peguam termasuk R. Sivarasa, Sankara Nair, Saiful Izham Ramli dan Sulaiman Abdullah.

Dengan ditemani ahli keluarga termasuk isteri Datuk Seri Dr. Wan Azizah Wan Ismail dan beberapa pemimpin PKR dan pasukan peguamnya, Anwar memberitahu, beliau menerima sapina daripada polis kira-kira sejam selepas Suruhanjaya Pilihan Raya (SPR) mengumumakn tarikh pilihan raya kecil Parlimen Permatang Pauh.

Sehubungan itu, Anwar yang juga Penasihat PKR berkata, beliau tetap akan bertanding dalam pilihan raya kecil tersebut walaupun ditahan dalam lokap sementara menanti perbicaraan kelak.

Anwar dijangka didakwa di bawah Seksyen 377A ataupun Seksyen 377C Kanun Keseksaan, berkaitan dengan perbuatan persetubuhan yang bertentangan dengan aturan tabii.

Jika sabit kesalahan di bawah Seksyen 377A, tertuduh boleh dihukum penjara maksimum 20 tahun dan dirotan manakala Seksyen 377C pula membawa hukuman tidak kurang lima tahun dan tidak lebih 20 tahun dan boleh dikenakan hukuman dirotan.

Seksyen 377A dan 377C tidak membenarkan jamin diberikan. Bagaimanapun di bawah Seksyen 388 Kanun Prosedur Jenayah, mahkamah boleh membenarkan jamin.

Dengan suara yang kelihatan 'agak sedih' di peringkat awal ketika membacakan kenyataan akhbar yang disediakan, Ketua Umum Pakatan Rakyat itu mengulangi bahawa tuduhan yang bakal hadapi esok - kali kedua dalam tempoh 10 tahun - merupakan satu lagi konspirasi politik kerajaan.

"Keputusan (membawa ke mahkamah) tidak mungkin berlaku tanpa arahan peribadi Perdana Menteri.

"Saya mendapat maklumat siasatan (dakwaan meliwat ini) menghadapi banyak masalah kerana tidak cukup bukti," katanya.

Anwar menambah, Datuk Seri Abdullah Ahmad Badawi menggunakan kesnya itu untuk mengalih perhatian daripada masalah-masalah yang dihadapinya.

"Hari ini Perdana Menteri ada krisis kepimpinan dan keyakinan semakin merudum," katanya lagi.

Terdahulu, Ketua Jabatan Jenayah Bukit Aman, Datuk Bakri Zinin mengesahkan bahawa pegawai penyiasatnya, ASP Jude Pereira telah pergi ke rumah Anwar untuk menyampaikan sapina tersebut.

Ketika ditanya apakah kandungan sapina berkenaan, Bakri bagaimanapun enggan mengulas.

"Maaf saya tidak boleh mendedahkan apa kandungan sapina tersebut," kata beliau ketika dihubungi mStar Online hari ini.

KENYATAAN TIMBALAN KETUA POLIS NEGARA

Timbalan Ketua Polis Negara, Tan Sri Ismail Omar berkata tindakan mendakwa Anwar diambil selepas pejabat Peguam Negara memutuskan untuk mendakwa beliau.

Satu notis bertulis kepada Anwar telah dikeluarkan untuk hadir di Mahkamah Sesyen Kuala Lumpur, Jalan Duta pada pukul 10 pagi esok, kata Ismail dalam kenyataan di sini hari ini.

"Polis telah menjalankan siasatan kes jenayah seksual melibatkan persetubuhan yang bertentangan dengan aturan tabii yang melibatkan Anwar, dengan berlandaskan prinsip undangundang dan prosedur sedia ada wujud dalam sistem perundangan negara.

"Kertas siasatan telah diserahkan kepada pejabat Peguam Negara untuk mendapatkan nasihat dan keputusan," katanya.

Difahamkan ASP Jude Pereira telah pergi ke rumah Anwar pada jam 12:05 tengah hari untuk menyampaikan sapina tersebut.

Beliau dikehendaki berada di mahkamah pukul 10 pagi esok.

Bernama melaporkan, sapina kepada Anwar, Penasihat Parti Keadilan Rakyat (PKR) untuk hadir ke Mahkamah Majistret Kuala Lumpur, Jalan Duta oleh Ketua Bahagian Siasatan Jenayah Ibu Pejabat Daerah Polis Bricfields, DSP Jude Pareira, di kediaman Anwar di Segambut Dalam di sini kira-kira 12.05 tengah hari tadi.

Pareira bagaimanapun tidak menjelaskan kandungan sapina itu dan tujuan Anwar perlu hadir ke mahkamah esok.

Anwar berhadapan dengan tuduhan meliwat kali kedua dalam tempoh 10 tahun. Kali pertama selepas beliau dipecat daripada jawatan parti dan kerajaan.

Beliau dipecat pada 1998.

Pada akhir Jun lalu, bekas pembantu Anwar, Mohd Saiful Bukhari Azlan mendakwa bekas Timbalan Perdana Menteri itu telah meliwatnya.

'Tetap kempen biar ditahan polis'

PKR tetap berkempen memastikan kemenangan penasihatnya Datuk Seri Anwar Ibrahim di Permatang Pauh walaupun beliau berada dalam tahanan polis jika gagal diikat jamin di mahkamah esok.

"Saya harap (perkara itu) tidak (berlaku). Sama ada ditahan atau tidak, kempen mesti diteruskan," kata Anwar, mengulas kemungkinan beliau tidak diberikan jaminan apabila dihadapkan dengan pertuduhan meliwat di mahkamah sesyen pagi esok.

"Minggu lepas, saya katakan dalam ceramah di Permatang Pauh, memang ada kemungkinan sarung dan songkok saya akan muncul tanpa tuannya (berkempen)."

Menurut peruntukan undang-undang, kesalahan-kesalahan liwat, pembunuhan, penculikan dan pengedaran dadah tidak dibenarkan ikat jamin.

anwar permatang pauh pc 060808 04Dalam sidang media di ibu pejabat PKR, Petaling Jaya petang tadi, beliau berkata, tiada alasan hakim menafikan hak beliau diikat jamin kecuali dengan niat "tidak membenarkannya berkempen" dalam pilihanraya kecil antara 16 hingga 26 Ogos ini.

Khamis lalu, penyandang kerusi itu Datuk Seri Wan Azizah Wan Ismail meletakkan jawatan sebagai ahli parlimen untuk memberi laluan kepada suaminya bertanding dalam pilihanraya kecil tersebut.

Ditanya sama ada tindakan polis menyerahkan notis hadir ke mahkahmah esok akan menjejaskan peluangnya di menang, Anwar berkata:

"Itu niat perdana menteri. Sama ada terjejas atau tidak, itu bergantung kepada pengundi Permatang Pauh."

Beliau turut menyifatkan penetapan 26 Ogos atau hari Selasa untuk proses membuang undi sebagai "unik".

"Biasanya tarikh hujung minggu sesuai untuk semua orang mengundi. Tetapi untuk saya, (hari pengundian) di Permatang Pauh ini unik.

"Di Permatang Pauh, ada ribuan pekerja kerajaan dan pekerja industri. Akan jadi masalah besar menguruskannya. Ribuan pekerja di kawasan itu akan mengalami kesulitan," katanya.

Mengulangi keyakinannya menang di kerusi tersebut, Anwar berkata:

"Saya kenal kawasan itu (Permatang Pauh). Wan Azizah berkhidmat di sana dengan baik. Kerajaan salah tadbir ekonomi. Kita ada alasan yang cukup (untuk yakin menang). Kita cuma bimbang cara pilihanraya itu dikendalikan."

"Kita tahu bagaimana mengendalikannya. Tetapi saya gembira majoriti Wan Azizah lebih tinggi daripada saya," tambahnya.

Isterinya dan juga presiden PKR menang dalam pilihanraya umum Mac lalu dengan majoriti 13,388 undi, meningkat mendadak berbanding 590 undi pada 2004. Beliau menguasai kerusi itu buat pertama kali dengan 9,077 undi pada 1999.

Dalam pilihanraya kecil ini, Anwar akan menumpukan isu-isu ekonomi untuk mengembalikan keyakinan pelabur.

"(Isu saya bawa) perubahan, cukuplah rasuah, salah tadbir negara dan tindakan musnahkan institusi kerajaan," katanya, sambil menambah beliau akan memfokuskan isu-isu ekonomi dan kenaikan harga petrol.

Diminta mengulas kemungkinan Suruhanjaya Pilihan Raya (SPR) menolak pencalonannya, Anwar berkata:

"Di Malaysia, apa pun boleh jadi, Malaysia boleh! Tetapi mengikut undang-undang, tiada kemungkinan (ditolak)," katanya sinis, disambut ketawa pemberita.

Tentang tempoh berkempen, Anwar mengakui 10 hari masa berkempen adalah pendek. Tetapi bagaimanapun, perkara itu telah diputuskan SPR, tambahnya.

Selain Dr Wan Azizah, timbalannya Dr Syed Husin Ali dan para pemimpin kanan PKR, kelihatan di sidang media itu peguam-peguamnya Sulaiman Abdullah dan Sankara Nair.

Very troubling reports have been published, which reveal the existence of a medical report of an examination done by a doctor on Mohd Saiful Bukhari bin Azlan a few hours before Saiful lodged a police report that he had been sodomised. The medical report apparently shows that there is no evidence that he had been sodomised by anyone.

Such reports raise some very serious questions that require immediate answers:

(1) Are the police in possession of such a medical report?

(2) Was the doctor concerned interviewed by the police and was he detained for any length of time?

(3) Is the doctor concerned facing any form of intimidation and, if so, by whom?

(4) Is there a medical report by another doctor that either confirms or contradicts the first medical report?

(5) If it is true that the medical report exists showing a lack of prima facie evidence, what then could have been the justification for the vigorous actions taken against Datuk Seri Anwar Ibrahim as well as the public call by the authorities for his DNA sample?

The answers to these questions are of paramount importance, as they bring into focus the integrity of our law enforcement system.

These latest disclosures regarding the investigations into the sodomy allegations are not the only ones to raise questions that need answering. There is, for example, also the issue of P. Balasubramaniam's abrupt "disappearance" that has yet to be satisfactorily explained. No one can deny that the circumstances of his first and second statutory declarations are highly unusual. All these show a pattern of events that cause much disquiet to right-thinking members of the public.

The Malaysian people are deeply troubled. A country that truly believes in the rule of law should not be faced with so many disturbing developments and unanswered questions.

The credibility of the Malaysian justice system as a whole is therefore at stake. The integrity of professionals, be they doctors or lawyers, must never be interfered with. The public must be left in no doubt that the criminal justice system in this country will not be misused or abused. There must be nothing less than an open and thorough investigation into these cases. This calls for the courage and professionalism of all those involved to do the right thing no matter the consequences. And those who have shown such courage and integrity must know that they live in a country where it is safe to do so.

Not a bailable offence, says Anwar's lawyers

PETALING JAYA, Aug 6 — Datuk Seri Anwar Ibrahim's campaign plans for the upcoming Permatang Pauh by-election, slated for Aug 26, may suffer a slight hiccup. His legal defence team, headed by Sulaiman Abdullah, is not certain that the veteran politician who is due to be charged for sodomy tomorrow morning will be able to obtain bail.

"It's a non-bailable offence but it is normally granted...except in the case of Anwar," added lawyer Sankara Nair on behalf of the rest of the legal team. He was referring to Sodomy I, when Anwar was denied bail for a similar charge in 1998.

However, Sankara did not immediately dismiss the possibility of bail. "So many sodomy cases go on in Malaysia. So many rape cases. So why should Anwar be denied bail?" he questioned.

He was reluctant to name the amount though, and said only that the amount for bail would depend on the court.

The team of lawyers, which also includes Parti Keadilan Rakyat (PKR) vice-president R. Sivarasa, and Saiful Izham, have been prepared to argue Anwar's case since July 28, Sankara said.

In the event bail is denied, the lawyers will immediately pursue an appeal. And if that should fail, Anwar may find himself back in Sungai Buloh prison, for a while at least.

While the exact nature of the charge is unclear, Sankara believes that the prosecution may choose to charge him under Section 377B of the Penal Code, which is sodomy by consent, rather than Section 377C, which is for sodomy without consent.

Sodomy, with or without consent, is illegal in Malaysia.

Press statement from Anwar Ibrahim

This morning the Malaysian Election Commission announced nomination and polling day for the by-election that I will contest in Permatang Pauh. I look forward to the campaign period to meet with voters in my home constituency. I invite all Malaysians to join me in this historic campaign to bring forth a New Dawn for Malaysia as we work together to build a more peaceful and prosperous nation.

At the same time we would reiterate our longstanding concerns about the integrity of the electoral process. To this date, the evidence of phantom voters and ballot box stuffing has yet to be addressed by the Election Commission. The poor handling of the use of indelible ink in the General Elections gives all Malaysians, particularly those in Permatang Pauh, reason to be concerned about the conduct of polling this month. I urge the Election Commission to take this opportunity to restore some credibility to its reputation by fulfilling its constitutional mandate to ensure that voting is fair and unbiased.

On a darker note, I regret to say that I fear an enormous injustice is about to be perpetrated upon the Malaysian people, worse than those actions taken in 1988 and 1998 which rendered almost irreparable harm against the institutions of democracy and the rule of law. While some individuals suffered greatly by those actions, the Malaysian people have been the greatest losers.

Tomorrow I will be charged with a crime I did not commit. The real criminals will, in their efforts to humiliate me and to derail the people's aspirations for transformational change in Malaysia, hide behind a smokescreen created by the government controlled mainstream media. This travesty of justice will take. It will happen with the active support and criminal involvement of the highest echelons of the police and politicians—including the office of the Prime Minister.

We have been informed that the Attorney General's chambers has advised against charging me after having studying the investigation papers. Despite its views, some individuals within the Police have insisted on pursuing this case even though the legal professionals in the AG's Chambers take a different view.

The evidence proves that the accuser lied in his initial report. He has been seen to be working in close collaboration with the police, notably his meeting with SAC2 Rodwan who was working hand in hand with Musa Hassan to conspire against me in 1998. Other witnesses in this matter have been threatened and harassed in order to fabricate evidence.

Doctors appear to have been pressured to violate all norms of medical ethics. Senior Ministers, in their comments about the case, have demonstrated their consistent interference in the investigation.

We are also informed that some individuals within the Prime Minister's close circles are adamant about pursuing this case. Their involvement further undermines the credibility of the case and proves that the entire conspiracy hatched against me is politically motivated.

Today the Prime Minister faces a crisis of confidence. His approval ratings have plummeted since the March elections and senior members of the Barisan Nasional have joined Pakatan Rakyat in droves. The economy under his abysmal management has reached its lowest in decades and all signs point to further weakening. And just yesterday prominent UMNO members have initiated an investigation into his own involvement in corruption and money politics. This is a man under siege - and he sees no way out but to deflect the attention of the Malaysian people with a sham trial against me.

He is now burning the forest to save his own tree!

I have thus far constrained my criticism of the Prime Minister to his failed policies and general incompetence in leading the nation. But now it is clear that his vendetta against those who would seek his early dismissal from office knows no boundaries and will transgress all limits of the rule of law.

I hold the Prime Minister personally responsible for the damage that is about to be done to the nation and to the integrity and dignity of the Malays.

Our international standing, recently lambasted by prominent leaders from around the world, will plummet even further. Overseas investors are already deeply skeptical about Malaysia on account of its reputation for deeply engrained corruption and economic inefficiency.

They will certainly be further dissuaded from any further activity in Malaysia. The continued decline in the economy will lead to greater unemployment and rampant stagflation.

I will fight this with the hope and energy of the people who have supported reformasi in Malaysia. I will not allow this cowardly attack to derail Pakatan Rakyat's agenda for change.

Insha'Allah we will win in Permatang Pauh. Insha'Allah we will win convincingly. I look forward to joining my colleagues in the Parliament to prepare for the historic transition that the country is eagerly awaiting.

ACA to record PM, DPM statements over power abuse report

KUALA LUMPUR, Aug 6 — The Anti-Corruption Agency (ACA) said today it will record statements from Prime Minister Datuk Seri Abdullah Ahmad Badawi and his deputy Datuk Seri Najib Abdul Razak over a report that alleged abuse of power in the run-up to Umno party elections in December.

ACA director-general Datuk Ahmad Said Hamdan said the statements will be recorded soon from both, who are Umno president and deputy president respectively.

Veteran Selangor Umno leader Datuk Mazlan Harun lodged a report yesterday with the ACA against Abdullah and Najib, both of whom have agreed to a power transition deal set for June 2010.

"The report is based on a letter," Mazlan said, referring to the letter written by Petaling Jaya Selatan Umno division head Kapt (R) Datuk Zahar Hashim which accused Abdullah and Najib of "political corruption of the highest order".

In the letter addressed to the Umno secretary-general, Zahar said the two top leaders had been campaigning to defend their positions despite asking others not to do the same. He also wrote that the top two leaders' actions were in violation of the guidelines issued by the party headquarters.

"This is to ensure that nobody will abuse their position and government machinery during the Umno elections. It is up to the ACA whether to take any action," said Mazlan.

"It is not only Umno members who want a fair election but also Malaysians and especially the Malay community want the same thing," he told reporters.

Mazlan, however, refused to say whether Abdullah's and Najib's names were mentioned in the report. "I can only say that my report is against the powers that be. Who are the most powerful people in this country?" he said.

He was also reluctant to reveal whether he was in possession of any evidence of corrupt practices in Umno. "It is up to ACA," he added.

Sodomy II not an open and shut case

AUG 6 — The way some government officials see it, Opposition icon Datuk Seri Anwar Ibrahim will be charged in court on Thursday, a few days should be set aside for the sodomy trial and the whole unsavoury episode should be wrapped up in the shortest possible time.

And then the whole country can move on. Guess what? It is not going to happen.

Sodomy II is not going to be an open and shut case. Not when you have in the dock, a politician fighting to salvage his career and maintain the respect of his family members and supporters.

Not when there remain questions about Mohd Saiful Bukhari Azlan, Anwar's former aide who alleged that he was sodomised by the former deputy prime minister on June 26 in a condominium in the tony neighbourhood of Damansara.

Buckets of muck are going to be flung during the trial and some of it will land on Anwar, some on Saiful, some on Datuk Seri Najib Abdul Razak, some on the Attorney-General Tan Sri Abdul Gani Patail, and some on the police force led by Tan Sri Musa Hassan.

By the time the verdict is delivered, it will be tough to separate the winners from the losers.

Sources have told The Malaysian Insider that police and government officials believe that they have sufficient physical and circumstantial evidence to obtain a conviction against Anwar. This includes DNA evidence, CCTV tapes and witness accounts.

But they acknowledge that the weakest link in the case could be Saiful. More specifically his behaviour and events leading to him lodging a police report could be tricky for the prosecution.

Saiful's decision to visit Najib at his Bukit Tunku home a few days before lodging a police report against Anwar adds a political dimension to the case, as does his move to hawk his story to several other politicians.

To be fair, it appears that the politicians - mindful of the stench still associated with the first sodomy charge 10 years ago - all advised Saiful to take his case to the police. He then visited the police and encountered a blue wall of doubt. As the story goes, police investigators were unwilling to accept his story at face value and sent him packing, telling him to return only with something more substantial.

He did so days later.

Anwar's battery of criminal lawyers will move to paint him as a pawn in a high-stakes political conspiracy, and will drag the police in as enablers in this scheme.

They will try and discredit the DNA evidence, dredging up the events of 1998 when Anwar's semen sample on a mattress allegedly used for his sexual liaisons was challenged.

The lawyers will want to know why Saiful continued to work as Anwar's aide and even agreed to go to the condominium on June 26, despite alleging that he was sexually assaulted during overseas trips to Singapore, Hong Kong and Jakarta.

Was he a willing partner? Was he a political plant? These and other questions will be asked during a trial which could be as meandering and damaging to the country and its institutions as Sodomy I was 10 years ago.

Open and shut case? Not a chance.

Anwar to be charged tomorrow for sodomy

(UPDATED) KUALA LUMPUR, Aug 6 - Datuk Seri Anwar Ibrahim will be charged for sodomy when he turns up at the Jalan Duta sessions courts tomorrow after police took a civil approach today and served him with a subpoena to appear in court. In a similar sequence of events 10 years ago, balaclava-clad elite policemen arrested him and detained him under the Internal Security Act before preferring charges.

His court appearance will come a day after the Election Commission decided that the Permatang Pauh by-election will be held on Aug 26 which Anwar said he will contest.

A police team led by DSP Jude Pereira served the subpoena just a little after noon today when they turned up at his Bukit Segambut house, which is incidentally near the Jalan Duta courts.

Anwar is scheduled to hold a press conference later at 3pm and Parti Keadilan Rakyat (PKR) officials said it could be related to a sodomy charge. He is currently speaking to his lawyers, according to lawyer Sankara Nair.

Anwar was arrested last month for questioning into the sodomy accusations made in a report lodged by former male aide Mohd Saiful Bukhari Azlan on June 28. Saiful had claimed Anwar sodomised him in a posh Damansara condominium on June 26 and other occasions abroad.

The former deputy prime minister has denied the charges which mirror charges a decade ago that cost him a chance to succeed former mentor Tun Dr Mahathir Mohamad as prime minister. Anwar has claimed Permatang Pauh is the final step before he forms the federal government by his self-proclaimed deadline of September 16.

Anwar was convicted for both corruption and sodomy and was given a total sentence of 15 years. He was released in 2004 after the Federal Court overturned the sodomy conviction but lost his Permatang Pauh seat which he had held since 1982. His wife Datuk Seri Dr Wan Azizah Wan Ismail took over and defended the seat for three terms before quitting last week to make way for him.

She remains PKR president and also created history by being the first woman Parliamentary Opposition Leader.

Meanwhile, Bernama reports that Deputy Inspector-General of Police Tan Sri Ismail Omar said in a statement today that the move to charge Anwar was made following a decision by the Attorney-General's office.

He said a written notice had been issued to Anwar to be present at the Kuala Lumpur Session's Court, Jalan Duta, at 10am.

"Police had carried out an investigation on a sexual crime involving intercourse against the order of nature involving Anwar, based on existing legal principles and procedures.

"The investigation papers had been handed over to the Attorney-General's office for advice and a decision," he said.

In a related development, PKR Youth condemned the summons as political intimidation against Anwar in light of the Permatang Pauh by-election date announced by the Election Commission earlier today.

"PKR Youth believes this action is reprehensible and cruel to prevent Anwar from campaigning actively and contesting in the by-election and we do not rule out political interference to prevent t Anwar from getting to Putrajaya," Youth chief Shamsul Iskandar Mohd Akin said in a statement.

He hoped the court will provide bail for Anwar even if the opposition leader is charged with sodomy.

Malaysia's hardline Islamists want ban of Avril Lavigne concert

Kuala Lumpur - The youth wing of Malaysia's hardline opposition Islamic party Wednesday called for banning a concert by Canadian pop star Avril Lavigne later this month, saying the singer's 'prancing' performances were not suitable for locals.

The 23-year-old singer is scheduled to hold a concert, her first in the Muslim-majority nation, in the capital Kuala Lumpur on August 29.

However, the opposition Parti Islam SeMalaysia (PAS) youth wing slammed the organizers for approving the show, saying the young pop-punk star's loud shows were not in line with local culture.

'This show is not suitable for our local culture,' said Herman Samsudeen, the wing's information chief.

'Our independence month should be marked by respect ... and not remembered by inviting the offsprings of colonists who will teach our children how to become modern monkeys, prancing around without any purpose,' he said in a statement.

Malaysia celebrates it's 51st year of independence of Britain on August 31.

'Approving this concert is a great insult,' the statement said.

Herman said the party would send an official protest note to the government to call for cancelling the show.

A party official declined to comment, as Lavigne holds Canadian nationality, saying only that Western influences in general were 'damaging' to local culture.

PAS, which has been in control of the northeastern state of Kelantan since 1990, has imposed strict religious laws dictating dress and all forms of entertainment in the state.

Among others, women entertainers are not allowed to perform in public, and men and women have to sit separately in cinemas.

( Dikemaskini ) Pengundi di Permatang Pauh akan menentukan ahli parlimen baru kerusi itu pada 26 Ogos ini dalam satu pilihanraya kecil yang paling dinanti-nantikan apabila Datuk Seri Anwar Ibrahim bertanding semula selepas tiga penggal.

Suruhanjaya Pilihan Raya (SPR) yang bermesyuarat hari ini menetapkan hari penamaan calon pada 16 Ogos.

Permatang Pauh merupakan kerusi tradisi Anwar selama 17 tahun sejak memenanginya pada 1982 atas tiket BN.

Isterinya dan juga presiden PKR Datuk Seri Dr Wan Azizah Wan Ismail menguasainya selama tiga penggal sewaktu Anwar dipenjarakan pada 1999 dan 2004 dan dilarang bertanding dalam pilihanraya umum Mac lalu.

Katanya, dalam satu ceramah di Bentong malam tadi, pemimpin- pemimpin BN dan jentera parti itu akan terus memburukkan namanya termasuklah dengan menaburkan fitnah.

"Sudah jadi tugas mereka untuk melemparkan fitnah terhadap saya tapi saya sekali-kali tidak akan mengalah," katanya di depan lebih 3,000 orang di Chegar Medang.

Ketika Anwar sedang berucap sekitar 11 malam, lampu tiba-tiba terpadam dan mencetuskan situasi panik seketika dalam kalangan penyokong-penyokongnya yang khuatir Anwar akan ditahan polis berhubung siasatan kes liwat.

Umno Bahagian Permatang Pauh Mahu Ketuanya Bertanding Pilihan Raya Kecil

BUKIT MERTAJAM, 6 Ogos (Bernama) -- Umno Bahagian Permatang Pauh mencadangkan ketuanya Datuk Abdul Jalil Abdul Majid sebagai calon Barisan Nasional untuk menentang Datuk Seri Anwar Ibrahim pada pilihan raya kecil bagi kerusi Parlimen Permatang Pauh.

Keputusan itu dibut pada satu mesyuarat khas jawatankuasa bahagian itu di sini pada malam Isnin lepas, kata setiausaha bahagian Ahmad Sahar Shuib pada mesyuarat jentera pilihan raya Umno yang dihadiri ketua-ketua cawangan dalam bahagian itu di sini malam tadi yang turut dihadiri Abdul Jalil.

Dalam sidang akhbar kemudiannya, Abdul Jalil menjelaskan bahawa terpulang kepada pucuk pimpinan parti untuk membuat keputusan.

"Kita akan akur dengan keputusan pucuk pimpinan parti dan kami bersedia membantu mana-mana calon yang ditentukan kelak," katanya.

Abdul Jalil berkata alasan di sebalik ketetapan itu ialah kerana tempoh berkempen adalah tidak lama dan Barisan Nasional perlu menggunakan setiap peluang dan masa yang ada untuk menjelaskan isu-isu yang dibangkitkan pembangkang.

"Dengan memilih anak tempatan yang sudah dikenali pengundi sebagai calon, mudah kita untuk mendekati mereka dan tidak perlu membuang masa untuk memperkenalkan calon berkenaan," katanya.

Kerusi itu dikosongkan oleh Presiden Parti Keadilan Rakyat Datuk Seri Dr Wan Azizah Wan Ismail bagi memberi laluan kepada suaminya, Anwar, bertanding semula.

Mengenai persiapan bagi menghadapi pilihan raya kecil itu, Abdul Jalil berkata Umno Bahagian Permatang Pauh menubuhkan 22 biro tersuk unit siber bagi menjamin jentera parti berjalan lancar.

Beliau berkata unit siber akan dipertanggungjawabkan memberi penjelasan mengenai sebarang isu semasa kepada golongan muda melalui blog dan sebagainya.

"Kita faham bahawa pengundi muda banyak mendapatkan maklumat melalui internet dan laman blog dan kita akan bagi peluang kepada mereka untuk bertanya atau mendapatkan sebarang penjelasan melalui cara itu," katanya.

Terdapat kira-kira 10,000 pengundi baru terdiri generasi muda di kawasan Parlimen itu pada waktu ini.

Abdul Jalil juga berkata mesyuarat agung 48 cawangan dalam bahagian Permatang Pauh yang dijadualkan berlangsung selepas 10 Ogos ini akan ditangguhkan sehingga selepas pilihan raya kecil itu.

Katanya Pengurusan Umno Pulau Pinang semalam membuat keputusan itu bagi membolehkan tumpuan diberi kepada pengendalian pilihan raya kecil itu.

"Mana-mana cawangan yang telah mengeluarkan notis untuk mengadakan mesyuarat sehingga 10 Ogos ini, kita benar ia diteruskan tetapi yang bercadang bermesyuarat selepas tarikh itu, kita minta ia ditangguhkan sehingga pilihanraya selesai," katanya.

Umno Permatang Pauh mempunyai 92 cawangan.

IT CAN only be described as poetic justice. In his pre-retirement days and out of the cabinet and the limelight, Datuk Seri S. Samy Vellu can take small consolation. When the beams of the MRR2 started to crack two years ago, with the approval of the cabinet, Halcrow, a British firm of engineering consultants was appointed to investigate the cause of the cracks, recommend the remedies and implement them.

All looked well and good. For RM12 million, the much-maligned MRR2 could be repaired and open to traffic with Halcrow’s input. But there was a bitter battle within the Works Ministry. The Public Works Department revolted. They did not want Halcrow as they had someone else in mind. Those in the know talked about a “civil war:” where the civil servants stood up to the political master and rightly so, spoke their mind.

Even a vociferous “it was decided by the cabinet” line was not acceptable to the “experts”. The top guns from PWD went to Putrajaya and met the prime minister, requesting that the cabinet decision be reversed. The asking price by the new firm – Leonard Andre and Partners (LAP) was a mere RM18 million – just RM6 million more and they were providing space-age technology – carbon-fibre to save the cracking pillars.

It did not matter that such technology had never been used in this part of the world but if RM18 million was the final price tag, there would be little to complain. But the price escalated to RM70 million (don’t ask me how and why) and what we got for that mammoth spending was drops of stones from the top of the flyover and a waste of taxpayers’ hard-earned money.

While Samy Vellu may have been vindicated and has every reason to thump his chest and say: “I told you so”, who is going to be accountable to the present state of affairs and the RM70 million bill? On Sunday, before the heavens opened up with more stones, concrete and pieces of carbon-fibre, his successor – Datuk Mohd Zin Mohd came out with guns blazing. “It won’t cost us anything because it is under warranty.” But that is not the issue. How do you compensate for the loss of time, effort and money caused by the closure? What price would you put on the inconvenience caused to thousands of people who use the road daily?

Who is going to be held accountable for this monumental man-made disaster? Everyone would scream and say: “Ask the ACA to investigate!” but this is not corruption, but a wrong decision which has resulted in Malaysians having to suffer for the follies of a few in high places. Don’t expect anyone to commit hara-kiri and don’t even expect any resignations. That’s not our style – it’s Western and by doing so, “we are aping the West.”

So, what can we expect? Can we anticipate someone standing up and saying: “Yes, I take responsibility. It was me who approved the use of carbon-fibre technology which had never been tested or used in Malaysia previously.”

Or would another stand up and say: “We made a wrong decision and we accept total responsibility for that decision.”

No dear readers. Right now, it’s hunting season and the hunt for the scapegoat(s) has just started. There will be many (including innocent parties) caught in the crossfire. But the pain can easily be compensated with lots of purple-coloured security paper.

The prime minister’s words are telling indeed. “When I read the newspaper headlines on my way here, I knew the public would not be happy. In fact, some will be pretty angry knowing that there is damage at the MRR2, even after spending a huge amount of money to repair it earlier.

“This could have been easily avoided if those responsible had ensured that earlier repair works were done properly. If this had been done, there would be no damage and the rakyat would not be fuming,” he told staff of the Prime Minister’s Department on Monday at its monthly gathering.

Yes, Sir, You are spot on, but do the people responsible for this debacle share your views? Do they care that the rakyat would be angry? Do they care that even after spending so much money, we cannot have safe roads? Do they care if they did not ensure remedial works were conducted properly?

No, Sir, They are in a world of their own. They don’t owe the rakyat anything, not even an explanation. They know that the rakyat are paying their salaries, but it makes no difference. For a while, people will talk about MRR2 and the problems. After two weeks, there’ll be another issue which will make headlines and attention is diverted elsewhere. Everything has been well-scripted.

Mr Prime Minister Sir, this is an opportune time for the government to show that it means business and that it will not accept dereliction of duty. This has been said so many times in the recent past by the Chief Secretary to the Government. It has to be done. Those responsible for this mess must be hauled up and held accountable for their actions or inaction. Only this can appease the angry rakyat who expect safe roads to drive on. After all, they pay their taxes which go towards the construction and maintenance of good roads. Anything less will be short-changing the people.

JOHOR BARU: At least three policemen have been identified as culprits behind the theft of RM1 million worth of syabu from the Johor police headquarters last week.

Two of them are in custody while a manhunt is on for the third suspect who is believed to be in possession of the drugs.

The New Straits Times learnt that the stolen drugs, part of a RM48 million haul by the police in March, was bound for the streets.

The policemen were planning to sell the drugs when the theft was discovered and immediate action was taken to identify the suspects.

At press time, a large-scale operation was on to nab the third suspect and retrieve the drugs.

Johor police chief Datuk Mohd Mokhtar Mohd Shariff is expected to hold a press conference later today.

Earlier the Johor police chief refused to comment on the case which was kept under wraps for several days until it was exposed by the NST in a front page report yesterday.

A grim-looking Mohd Mokhtar was followed from the state police headquarters to Kota Tinggi by hordes of reporters, but he declined to comment.

The report stated that the drugs were stolen from the Johor police headquarters after thieves used acid to melt the padlock to the storage room.

A police report was lodged on the theft following which more than 60 police personnel, who were on duty at the time of the break-in, were screened for drug abuse.

One policeman reportedly tested positive and it is now learnt that he is one of the two suspects in custody.

All three suspects are believed to be general duty policemen.

The drugs were seized from an international syndicate which had been operating in at least three locations in Johor Baru. The RM48 million haul was said to be the biggest in recent years.

In the operation in March, police arrested 12 suspects, including three Singaporeans and a Thai woman.

They were involved in the manufacturing of the drugs at two makeshift laboratories. The drugs were meant for the foreign market.

The theft had raised serious concerns as it could have jeopardised the trial of the 12, but it is learnt that police have sufficient evidence to continue with the case.

At least two other similar cases of theft of evidence had occurred previously.

One was at the Kota Baru district police headquarters where 1,000 psychotropic pills, 7g of heroin and 400ml of cough mixture worth RM40,000 were stolen.

Earlier 60,000 psychotropic pills worth almost RM1 million were found missing from a vault at the Selangor police headquarters.

SHAH ALAM: Three phone logs which put murder accused Chief Inspector Azilah Hadri at the crime scene on the night Altantuya Shaariibuu was murdered were inaccurate and unreliable, the High Court heard yesterday.

Counsel J. Kuldeep Kumar said the three documents containing information on the telecommunication centre's base stations to trace the location of handphone users could not be relied on because they did not have a permanent radius.

Kuldeep, who is representing Azilah, was making submissions at the end of the prosecution case to exclude three of Azilah's phone logs which placed him at the crime scene on the night of the murder.

"According to a witness from Celcom, Haizal Hambali, the base station coverage overlaps from one area to another. It was also established that no signals could be obtained to complete call transactions at hilly areas, while a low signal would be captured in jungle areas."

Kuldeep submitted that one of the logs (a call details record) was not provided for prepaid customers (such as Azilah) to allow him the opportunity to see if the site name information was accurate.

"The arrangements of the call log, structure and column were also incomplete and not organised.

"Further, another witness from Celcom, Nik Kamarudin Nik Ka, testified that he did not know if the data in the logs were manipulated or altered."

Kuldeep argued that there were 21 missing data from the log extraction which could have exonerated Azilah.

"There were also mistakes in technical terms for SMSes and calls made in the logs. This proves that the computer printing these documents was faulty and that the information contained was inaccurate."

Azilah, 31, and Corporal Sirul Azhar Umar, 36, both Special Action Squad members, are charged with murdering Altantuya at Mukim Bukit Raja, Selangor, between 10pm on Oct 19 and 1am the following day. Political analyst Abdul Razak Baginda, 47, is charged with abetting them.

Submissions before High Court judge Datuk Mohd Zaki Md Yasin continue today.

Damned if I do, damned if I don't, says Anwar

(UPDATED) BENTONG, Aug 6 — In a dramatic retelling of recent events, Datuk Seri Anwar Ibrahim last night shared with his supporters the difficulties he was facing with his detractors and the authorities.

With fresh accusations of sodomy blighting him, he told the audience in Benus near here that prior to his journey, he had heard rumours of his arrest earlier in the afternoon.

And painting the picture of a man who appeared to already have his hands tied, the former deputy prime minister admitted that he has had to face criticisms for every move he makes.

"If I were to run in Kulim Bandar Baharu, they would say I wanted my wife and daughter with me in Parliament," Anwar said, referring to his wife Datuk Seri Dr Wan Azizah Ismail, who quit her Permatang Pauh seat last week to make way for him in a by-election, and daughter Lembah Pantai MP Nurul Izzah.

"Now that I am running in Permatang Pauh, they say Wan Azizah has cheated and wronged the people. Why don't they let the voters decide what is right or wrong?" he thundered to the cheering crowd of a few thousand people.

The Election Commission meets later this morning to decide on the nomination and polling dates for the by-election in Permatang Pauh, which Anwar held between 1982 and his arrest in 1998.

The Parti Keadilan Rakyat de facto leader also told the story of his arrest, in terms of the orders he was asked to obey.

"They asked me go to the hospital. Why? I'm not sick. But if I don't go, they say I am not cooperating. They asked me to strip. If I refuse, I am wrong. They asked me to fill in a rape victim's form as well.

"Finally when I refused to have a picture of me taken naked, they say Anwar is not cooperative," he said in his hour-long speech.

Forty minutes into his speech, the electricity supply was interrupted and his security team immediately leapt on stage to cover their leader in the midst of the darkness.

Although no cause could be discerned, talk of sabotage has been prevalent since the audio cable was cut at a ceramah in Bagan Datoh last Friday night.

The 10-minute power outage occurred minutes after he was telling his audience about the large presence of police personnel at his regular political rallies.

"Why did they have to bring such a big team? Just one corporal would've sufficed."

He also pointed out that the government's recent announcement of a likely drop in fuel prices as a ploy to sway the by-election in Barisan Nasional's favour.

"I'm not surprised. But if they want to do it, bring it down to RM2," he said, referring to his own promise that if Pakatan Rakyat were to form the federal government, it would set the petrol price at that figure.

He also told the largely Malay crowd here that he was never worried over the Umno-Pas talks as he had a direct line of communication to Pas president Datuk Seri Abdul Hadi Awang.

Instead, he described the entire episode a plan by Pas to unveil Umno's desperation.

"Hadi assured me that Pas were committed to Pakatan Rakyat. In fact, it was all just a clever ploy.

"They flirted with Umno until it had made all these promises and announcements about giving Pas menteri besar positions and then after a meeting, Hadi announced that there was no way it would form government with Umno."

Lebih 50 peratus katakan 'Tidak' pada Umno

Selain populariti Perdana Menteri Dato' Seri Abdullah Ahmad Badawi yang jatuh merudum lebih 50 peratus, hasil kajian Merdeka Centre baru-baru ini juga membuktikan 58 peratus responden menyatakan 'tidak' kepada Umno sebagai parti yang memenuhi aspirasi dan kehendak rakyat.

Kajian yang dibuat pada Julai lalu yang melibatkan sejumlah 1,030 rakyat Malaysia memaparkan populariti Abdullah pada November 2004 adalah dalam kedudukan 91 peratus iaitu merupakan rekod yang tertinggi tetapi jatuh kepada 61 peratus setelah sepenggal menjadi Perdana Menteri.

Lebih mengejutkan ianya terus menjunam kepada 53 peratus pada bulan April sejurus selepas 8 Mac dan yang terkini jatuh kepada 42 peratus.

Kata Naib Presiden KeADILan Azmin Ali bahawa maruah Perdana Menteri, Dato' Seri Abdullah Ahmad Badawi terus merosot sekaligus memberikan gambaran prestasi ekonomi, pelancongan, pelaburan berada di tahap 'paras hidung' malah jika silap langkah pastinya Malaysia berada di kelompok negara miskin.

Selain itu, berhubung sama ada Dato' Seri Najib Razak boleh menjadi seorang Perdana Menteri yang baik, kajian Merdeka Centre itu menunjukkan 47 peratus menyatakan 'Tidak' dan memberikan respon yang negatif.

Manakala sejumlah 55 peratus responden pula tidak percaya dakwaan liwat terhadap Anwar, 11 dan 26 peratus percaya fitnah tersebut dan selebihnya tidak pasti sama ada dakwaan itu benar atau sebaliknya malah dakwaan terhadap Anwar itu dikaitkan dengan motif politik dipercayai oleh sejumlah 66 peratus responden.

Majoriti responden sudah hilang keyakinan kepada badan kehakiman, Jabatan Peguam Negara dan Polis Diraja Malaysia (PDRM) yang menjalankan tanggungjawab secara adil dan telus terutama membabitkan kes dakwaan liwat Anwar yang terkini.

Hasilnya sejumlah 50 peratus tidak percaya kepada badan kehakiman, 53 peratus Peguam Negara manakala 55 peratus terhadap polis.

Bagi Penasihat DAP Lim Kit Siang yang mendedahkan hal sama menggesa Abdullah dan kerajaan BN menggugurkan tuduhan liwat terhadap Anwar sebagai langkah untuk menamatkan krisis keyakinan rakyat terhadap beliau dan kerajaan pimpinannya memulihkan kembali poltik semasa, ekonomi dan krisis pembinaan bangsa.- tmj_

Jangan selalu 'buat gimik' nanti orang tak percaya

BIRO Angkatan Muda Parti Keadilan (Rakyat?) telah mengirimkan kenyataan menerusi email saya yang menghebuhkan Ketua Umum PKR, Anwar Ibrahim akan ditangkap hari ini.

Buat masa ini lebih 100 orang berhimpun di rumah Anwar. Maklumat itu diperolehi dari Kelab Penyokong Anwar (AIC).

Saya ucap terima kasih atas kirimkan maklumat berkenaan. Namun saya ingin persoalan sejauh manakah kesahihah mengenai maklumat berkenaan. Kalau ia sekadar andaian dan gimik tidak usahlah diperpanjang dan hebuhkan.

Apa lagi kalau tujuannya untuk menarik orang ramai agar mengerumuni ke rumah Anwar di Bukit Segambut.

Sukar untuk saya nak yakin kalau Polis ingin menangkap Anwar dalam tempoh beberapa hari ini. Pertama, apakah kesalahan Anwar? Beliau tidak melakukan apa-apa jenayah yang memungkinkan beliau ditangkap.

Beliau juga tidak melakukan apa-apa provokasi berhubung laporan liwat ke atasnya oleh si pembacuh kopi tempoh hari.

Kedua, beliau tidak menunjukkan ingin menggerakkan massa membuat huruhara. Bahkan Anwar memberi kerjasama baik kepada pihak keselamatan.

Ketiga, pilihan raya kecil Permatang Pauh akan diadakan tidak lama lagi. Menangkap Anwar bermakna rakyat makin marah dan sokongan kepada Anwar akan meningkat. Jika kerajaan berbuat demikian ini bermakna kerajaan tidak bijak dan sengaja menggali kubur untuk menimbus diri sendiri dalam pilihan raya kecil itu.

Keempat, tidak ada tanda-tanda untuk Anwar melarikan diri ke luar negeri. Kenyataannya yang bersedia menjadi calon menunjukkan beliau komited dengan politik Malaysia. Bukankah Anwar seorang yang bernani menghadapi apa saja kemungkinan.

Jadi alasan dan andaian mengatakan beliau akan ditangkap pada saya hanyalah gimik sahaja untuk menarik orang ramai berkhemah di rumah Anwar. Anwar pula membuat telahan demikian sebagai satu daripada tektiknya untuk mendapat simpati lebih sahaja. Untuk apa?

Diharap PKR khasnya Angkatan Mudanya tidak terlalu bermain politik, mudah mempercayai khabar angin dan sesekali biarlah kita rasional dan berpijaklah atas bumi nyata.

Kita kita kena ingat Anwar bukan segala-gala bagi kita dan ia hanya sebahagian daripada ikon perjuangan kita untuk negara, bangsa dan agama. Kalau terlalu banyak kita bergimik lama kelamaan kita tidak akan dipercayai selama-lamanya.

SPR, BN bermesyuarat hari ini fokus Permatang Pauh, SAPP

(Mutakhir) PETALING JAYA: Dua mesyuarat berasingan diadakan oleh entiti berkaitan politik tempatan - Suruhanjaya Pilihan Raya (SPR) dan Barisan Nasional (BN) - hari ini - selang empat jam - sudah pasti yang menarik untuk diperhatikan.

SPR akan mengadakan mesyuatat pukul 10 pagi ini di Putrajaya bagi menentukan tarikh pilihan raya kecil kerusi Parlimen Permatang Pauh manakala BN akan mengadakan mesyuarat jawatankuasa pengurusan pukul 2.30 petang dan disusuli dengan pertemuan Dewan Tertingginya dua jam kemudian.

Kerusi Parlimen menjadi kosong ekoran keputusan penyandangnya, Datuk Seri Dr. Wan Azizah Wan Ismail melepaskan kerusi tersebut selepas menang dalam tiga pilihan raya umum yang lalu.

Ia bakal muncul sebagai pilihan raya kecil yang pertama selepas pilihan raya umum ke-12 8 Mac lalu.

SPR dijangka memutuskan tarikh pilihan raya kecil, yang dijangka sama ada hujung bulan ini ataupun awal September.

Suruhanjaya itu perlu mengadakan pilihan raya kecil dalam tempoh 60 hari daripada tarikh kekosongan.

Semalam ketika dihubungi mStar Online, Pengerusi SPR, Tan Sri Abdul Rashid Abdul Rahman memberitahu, sama ada pilihan raya akan diadakan dengan cepat ataupun sebaliknya akan diputuskan dengan mengambil kira pandangan ahli-ahli panel SPR.

Suami Dr. Wan Azizah, Datuk Seri Anwar Ibrahim yang pernah menyandangnya dari 1982 hingga 1999 dijangka bertanding semula kali ini.

Dr. Wan Azizah, Presiden Parti Keadilan Rakyat (PKR) memutuskan untuk mengosongkan kerusi itu Khamis lalu.

Dalam pada itu, Setiausaha Agung BN, Datuk Seri Tengku Adnan Tengku Mansor berkata, keputusan tindakan lanjut terhadap Parti Maju Sabah (SAPP) akan dibincangkan dalam mesyuarat jawatankuasa pengurusan BN dan Dewan Tertinggi BN hari ini.

Ia juga dijangka membincangkan strategi menghadapi pilihan raya kecil Permatang Pauh.

Kata beliau, pada mesyuarat esok, isu mengenai jawapan kepada surat tunjuk sebab parti berkenaan susulan pendirian undi tidak percaya terhadap kepimpinan Perdana Menteri, Datuk Seri Abdullah Ahmad Badawi akan dibincangkan dengan teliti.

“Ya, kita akan bincang isu SAPP. Mula-mula kita bincang dalam mesyuarat jawatankuasa pengurusan... selepas itu kita akan bawa (bincang) dalam mesyuarat Dewan Tertinggi pula,” katanya ketika dihubungi.

Ditanya sama ada keputusan untuk mengambil tindakan terhadap SAPP akan diputuskan dan diumumkan esok, beliau enggan mengulas lanjut.

“Sabarlah, kita tunggu esok. Bincangpun belum lagi. Biar Pengerusi BN yang umumkan esok,” katanya.

Pada 1 Julai lalu SAPP menerima surat tunjuk sebab daripada BN berhubung perkara ini melalui perkhidmatan pos laju.

Surat itu telah dijawab oleh SAPP 29 Julai lalu.

Di Kota Kinabalu, Setiausaha Agung SAPP, Datuk Richard Yong berkata, pihaknya berpendirian terbuka dalam hal ini.

"Kami berharap mereka akan melihat pandangan kami. Apa jua keputusan, kami akan menentukan tindakan susulan daripada keputusan BN nanti," kata beliau.

SAPP menyertai BN pada 1994 dan mempunyai dua wakil rakyat di Dewan Rakyat dan wakil dalam Kabinet negeri.

Sementara itu Pengerusi Kelab Penyokong Kerajaan BN (BBCBN) Sabah, Datuk Anifah Aman berkata, pihaknya mengharapkan keputusan yang baik daripada BN esok.

Kata beliau, BBCBN Sabah masih yakin SAPP akan kekal dalam BN atas alasan kesemua parti perlu bersama untuk memperkukuhkan kerajaan negeri Sabah demi membantu pembangunan negeri dan rakyat.

"Matlamat kami sama iaitu berjuang untuk kepentingan rakyat Sabah walaupun pendekatan Datuk Yong Teck Leel berlainan. Cara terbaik ialah mereka, SAPP kekal dalam BN dan berharap akan berubah pendirian dan kekal dalam BN," katanya lagi.

Pada 14 Ogos ini, Majlis Tertinggi Umno akan mengadakan mesyuarat.

Pengkhianat negara! - Sempena Bulan Kemerdekaan.

Ada dua manusia yang menjadi pengkhianat negara sebelum merdeka. Manusia pertama - Lai Te, setiausaha agung PKM sebelum Chin Peng. Lai Te telah membatalkan rancangan kemerdekaan selepas sahaja fasis Jepun menyerah diri, dengan mengatakan British sudah mendarat. Kalau tak, kita sudah merdeka sama dengan dengan Indonesia merdeka, iaitu pada Ogos 1945. Akhirnya, Lai Te menerima hukuman yang setimpal dengan pengkhianatan yang dilakukannya.

Seorang lagi manusia pengkhianat negara ialah Dato' Sir Onn Bin Jaafar. Pada zaman pendudukan fasis Jepun, manusia Onn Bin Jaafar ni menyertai KRIS (Kesatuan Rakyat Indonesia Semenanjung) yang ditubuhkan selepas KMM (Kesatuan Melayu Muda) diharamkan oleh fasis Jepun ni. Kemudian, selepas saja fasis Jepun menyerah kalah, Onn Bin Jaafar ni keluar dari KRIS dan mengutuk perjuangan kemerdekaan ni. Onn Bin Jaafar ni tidak yakin bahawa bangsa Melayu ni boleh memerintah negara sendiri. Bangsa Melayu hanya boleh hidup di bawah ketiak British. Onn Bin Jaafar ni boleh cakap "di bawah pemerintahan British, orang Melayu boleh makan daging, tetapi jika merdeka orang Melayu harus makan ubi kayu" (menurut memoir Abdullah CD bahagian kedua). Onn Bin Jaafar ni juga memperlekeh perjuangan kemerdekaan yang dibawa oleh gerakan-gerakan lain seperti PKMM (Pertubuhan Kebangsaan Melayu Malaya) dan apalagi PKM (Parti Komunis Malaya). Katanya lagi, "macam mana kita nak lawan British, diorang ada kapal selam, askar, senapang cukup lengkap. Kita ada apa?".

Akan tetapi, dengan semangat jiwa merdeka, PKMM dan gerakan-gerakan kiri yang lain seperti API, AWAS, SEDAR dan HIZBUL MUSLIMIN serta BTM telah berpadugabung menubuhkan PUTERA (Pusat Tenaga Rakyat) dan bekerjasama pula dengan gabungan gerakan kiri dari bukan Melayu - AMCJA (All-Malaya Council of Joint Action). Gabungan ini dengan membawa slogan MERDEKA telah merencanakan sebuah perlembagaan yang diberi nama yang sangat sedap - PERLEMBAGAAN RAKYAT. Kalau tak, kita dah merdeka dah pada tahun 1947. Dah dua kali dah kita tertangguh kemerdekaan. Pada waktu ketika inilah, Onn Bin Jaafar ni yang membantah perjuangan kemerdekaan ni, yang telah menubuhkan UMNO pada 11 Mei 1046 ni, telah memecahbelahkan bangsa Melayu dengan membawa slogan HIDUP MELAYU (sebenarnya slogan ni panjang lagi - HIDUP MELAYU DITENTUKAN OLEH BRITISH).

Semasa PERLEMBAGAAN RAKYAT ni diumumkan, Onn Bin Jaafar ni telah berpakat dengan Raja-raja Melayu (jadi Rajalinggam jangan harap nak masuk buku), dan Onn Bin Jaafar ni juga berpakat dengan British untuk mewujudkan sebuah Persekutuan Tanah Melayu dengan membawa PERLEMBAGAAN PERSEKUTUAN. Dan sejak itu, British mengharamkan parti-parti atau pertubuhan-pertubuhan lain kecuali UMNO. Maka, mereka yang diharamkan oleh majlis fatwa British ni pun terus memegang slogan (orang kita ni dengan slogan tak boleh dipisahkan) 'AYUH PULANG KE KAMPUNG, KITA BERGERILLA'! Maka, darurat pertama Malaya 1948 bermula dan bermulalah juga Akta Keselamatan Dalam Negeri (ISA).

Oleh kerana gerakan-gerakan yang memperjuangkan merdeka ni diharamkan, mana yang tak nak masuk hutan tu, dia join UMNO. Oleh kerana semangat mereka masih membara, maka UMNO dengan tak malunya menukar slogan mereka kepada MERDEKA.

Di sini, aku bukan nak buka kelas sejarah Malaya. Tapi aku nak ceritakan bahawa Onn Bin Jaafar dan UMNO sebenarnya bukanlah pejuang kemerdekaan tulen dan Malaya sebenarnya masih belum merdeka! Darurat bermula 1948 dan berakhir pada 1960. Tetapi kita merdeka 1957. Apa ertinya kemerdekaan ni kalau kita masih lagi dalam darurat? Apa yang merdekanya? Merdeka bermakna kita bebas segala-galanya. Tak ada lagi belenggu sama ada belenggu jasmani mahupun rohani! Bila dilihat kembali perangai UMNO yang diperkenalkan oleh manusia yang bernama Onn Bin Jaafar ni, UMNO sehingga ke hari ini tidak pernah menjaga kepentingan dan membela rakyat. Sebaliknya mereka menjaga kantung dan usus mereka yang terdiri dari kerabat di-raja dan golongan bangsawan (Bangsawan Bintang Timur tak masuk buku ha.. kalau tak, Rahman B dah ada istana kat Bukit Tunku dah...).

Kebudayaan yang dibawa UMNO, yang wujud hari ini bukanlah kebudayaan rakyat. Sebaliknya kebudayaan feudal. Rakyat umum tidak memakai songket. Gamelan bukan muzik rakyat. Berpantun juga bukan gaya rakyat. KERIS bukan senjata rakyat! Senjata rakyat ialah cangkul, kapak dan parang. Nak kata raja merakyat lalu terbuka hati untuk berkongsi kebudayaan dengan rakyat, adakah rakyat boleh menerima kebudayaan istana ini sedangkan jiwa rakyat bukan di istana! Jiwa rakyat di ladang-ladang. Rakyat ada lagu sendiri, ada tarian sendiri yang tak mementingkan aksesori dengan kilauan emas.

Malah bukan sahaja kebudayaan yang jadi mangsa. Pendidikan dan perubatan juga sama. Rakyat tidak diberi pelajaran secara ilmiah di bawah hegemoni UMNO ni. Lebih-lebih lagi sekarang ni. Pendidikan sastera lebih malang. Dahlah sekarang ni zaman internet dan bahasa Melayu sudah dirosakkan. Boleh pulak cucu kepada pengkhianat negara ni yang jadi menteri pelajaran ni bawa karya Ahadiat Akashah sebagai rujukan sastera di sekolah? Tak payah tengok tu, tengok saja Kamus Dewan. DBP tak pernah membantu rakyat membaca sebenarnya. Buku-buki yang diterbitkan dicetak di atas kertas mahal. Jadi, buku-buki dan kamus terutamanya berharga mahal nak mampus! Tak macam Oxford yang ada cetakan yang dibuat atas 'paperback' dan harganya lebih murah! Perubatan jangan cerita lah. Kita sekarang ni kalau tak ada insurans, jangan harap nak dapat masuk hospital yang ubatnya bagus.

Jadi, Onn Bin Jaafar dan UMNO adalah peniru genius rakyat. Sebab tu, kita tak ada lagu negara original dan bendera bukan dari warna bumi kita. Dan ISA masih diteruskan sebab UMNO bukanlah kerajaan yang berdikari tetapi atas nama lain Malaya masih lagi di bawah British. Kes ni samalah dengan Melayu nak buka pub tapi undang-undang tak benarkan Islam menjual arak. Lalu Melayu ni guna nama Cina sebagai lesen...

Korang ni, faham ke tak ni? Kalau tak faham, korang ni memang UMNO lah!
